Scott Spencer, Partner, Miller Thomson: Capacity & Undue Influence
Scott’s topic for this month’s lunch and learn is “Capacity and Undue Influence”. From the CAFA perspective, the best transition plan is of little value if, at the end of the day,
there is a legal dispute over testamentary “capacity” or whether there was “undue influence” at some stage of the process.
Scott’s presentation promises to provide a little bit of legal insight with undoubtedly a fair bit of humour.

His practice has been built on a wide range of litigation, including everything from Environmental Impact Assessment Hearings to criminal trials. Scott has negotiated
(always the preferred option) resolutions to many estate and family disputes and, when necessary, has successfully litigated the disputes up to and including the Court of Appeal.
